The Revenue Department has frozen almost Bt100 million in bank accounts of fugitive former prime minister Thaksin Shinawatra as a consequence of his tax-evasion case which was revived earlier this year.

The ex-PM is convicted of avoiding billions of baht in taxes when he sold his shares in Shin Corp, a family business, valued at more than Bt70 billion in 2006.

The case would not expire for 10 years after the Revenue Department ordered Thaksin to pay Bt16 billion in taxes in March.

A source in the department said the agency would continue to freeze Thaksin’s assets when they are found.

Na also, wer sagts denn!
Jetzt hat man doch tatsächlich Thaksins Portokasse gefunden!
Und angeblich sogar beschlagnahmt!

Former prime minister Yingluck Shinawatra said on Friday she is ready to give her closing statement in the rice-pledging case in which she is accused of failing to stop the corruption-plagued scheme, which resulted in over 500 billion baht in damages.

But Ms Yingluck said she still has to consult her lawyers as to whether she should request to verbally present her closing statement at the final witness hearing or submit a written version instead.

Thaksins Nummerngirl wittert Morgenluft!

Deputy Prime Minister Prawit Wongsuwon has given the cold shoulder to former premier Yingluck Shinawatra’s pleas for justice over charges against her in connection with the rice-pledging scheme.

He said everyone must adhere to the law.

Gen Prawit was speaking Monday after he was asked by a reporter whether the regime would be lenient to Ms Yingluck, who cried while speaking to the media as she made merit at Wat Saket to mark her 50th birthday last Wednesday.

Asked about Ms Yingluck’s recent activities via Facebook Live as the court hearings in her case are about to come to end, Gen Prawit said he had no opinion on the matter.

The former prime minister is defending herself in the Supreme Court’s Criminal Division for Holders of Political Positions against a charge of dereliction of duty in the loss-ridden scheme. Ms Yingluck was chair of the National Rice Policy Committee when she was in power.

Former prime minister Yingluck Shinawatra turned 50 on Wednesday, and took the opportunity to call for sympathy and fairness from the courts in her fight against charges arising from her rice subsidy scheme.

alleinerziehende arme Thai Mutter musste ihren 50.Geburtstag

Judges have dismissed a plea for justice by Yingluck Shinawatra, who claims that defence witnesses in her trial are being intimidated by the National Anti-Corruption Commission.

The former prime minister outlined her complaint on Friday in a letter to the Supreme Court’s Criminal Division for Political Office-Holders, where she is being tried on charges of negligence in connection with a rice-pledging scheme that cost taxpayers hundreds of billions of baht.

Ms Yingluck claimed she had not been treated fairly by the NACC and the prosecutors.

She said that Supa Piyajitti, a former deputy permanent secretary for Finance, who was a prosecution witness, is now an NACC commissioner and a member of the anti-graft agency’s investigation panel.

She said it had become a pattern that after her witnesses had testified, the NACC would set up a panel to investigate each one of them.

THB Taschengeld in Thailand belassen

Ex-premier Yingluck Shinawatra spends a staggering Bt2.65 million per month to cover personal and family expenses as well as her visits to former constituents, she told a court recently in a failed injunction request.

Of that Bt2.65 million outlay, Bt450,000 is spent during visits to her former constituents and supporters in Bangkok and other provinces, while about Bt1 million is listed as household expenses.

In addition, the former prime minister spends another Bt200,000 per month to cover her young son’s education and other expenses. She told the court her expenditure on legal expenses is about Bt200,000 per month, while her personal spending budget is about Bt800,000.

The figures were cited to back her petition for the Central Administrative Court to grant an injunction ahead of the government’s bid to seize her assets.

Yingluck is facing a civil liability lawsuit in which the government is seeking Bt35 billion in compensation to cover alleged financial damage caused by her previous government’s ricepledging scheme.

The government’s factfinding committee concluded that the unlimited ricepledging scheme had led to a Bt500 billion loss for the government. Yingluck, it contended, was partly accountable for the financial damages due to her failed supervision of the scheme.

On Monday, the court by a majority dismissed Yingluck’s request for an injunction, reasoning that the government had not proceeded to seize her assets at this stage.

A minority of two judges on the court’s panel had argued for granting the injunction on grounds that Yingluck would be damaged by the government’s civil liability action while other related lawsuits were still pending in court.

Panuphun Chairat, deputy directorgeneral of the Central Administrative Court, took the view that impartiality in this civil liability lawsuit seeking the massive compensation from the expremier was questionable given that the National Council for Peace and Order (NCPO) had seized power from a civilian government in 2014.

Another judge on the panel, Watchira Chobtaeng, said that the government’s attempt to seek the massive compensation from Yingluck may not be legal. In addition, the expremier would not be able to live a normal life if the government moved to seize her assets while all related lawsuits were still pending.

The two judges believed that the court should provide temporary protection to Yingluck by granting the injunction.

absoluten Existenzminimum herumkrebsenden alleinerziehenden Mutter

Töchtern welche in allen Kulturen

THE COMMERCE Ministry will formally ask the Legal Execution Department this week to confiscate Bt20 billion from former officials held responsible for losses stemming from allegedly fake rice-export deals announced as part of the previous government’s rice-pledging scheme.

The decision was reached at a meeting yesterday between senior officials from the departments of Foreign Trade and Legal Execution, with the order to confiscate to be made on Tuesday – Valentine’s Day.

Duangporn Rodphaya, director general of Foreign Trade, said that both agencies had been working closely on the matter.

She said that her department was gathering necessary documents required for seeking compensation from the people involved.

“We will be able to submit our request to the Legal Execution Department by February 14 for further proceedings,” she said.

Duangporn said yesterday her department was in the process of gathering information about assets of the six former officials, as part of the confiscation move.

“The two agencies are |working closely together to make sure the proper proceedings are followed. The goal is to ensure maximum benefit for the |country,” she said.

The Department of Foreign Trade is the damaged party.

Former commerce minister Boonsong Teriyapirom, his former deputy Poom Sarapol, plus Manas Soyploy, a former director-general of the Department of Foreign Trade, his former deputy Tikamporn Natvorathat, and Akrapong Theepvajara, ex-director of the Foreign Rice Trading Office, face civil lawsuits to recoup a combined Bt20-billion-plus over the alleged fake government-to-government |rice deals.

On Friday, they failed to obtain a court injunction from the Central Administrative Court against a government order to proceed with the controversial moves.

Boonsong said he would appeal against the ruling.

Ruenvadee Suwanmongkol, director-general of the Legal Execution Department, said that if the Department of Foreign Trade submitted the documents completely, her agency would go ahead with legal proceedings promptly.

Boonsong said confiscation of assets should not be executed at a time when a court case against him and other former Commerce officials was still underway, with no verdict |delivered yet.

“They should allow the defendants to complete their court battle before taking any action,” he said.

He said he would seek an injunction from the Administrative Court again if the Legal Execution Department notified him about imminent asset seizure.

Meanwhile, Democrat Party politician Warong Dejkitwigrom said the authorities involved should report to the public regularly on the progress of their moves to confiscate those assets, in order to ensure transparency in regard to this matter.

“It’s the duty of the Legal Execution Department to seize their assets until a future notice from the Administrative Court,” the politician said in a Facebook message.

Und natürlich was damit geschieht.

FORMER Finance minister Kittiratt Na-Ranong has strongly defended former premier Yingluck Shinawatra’s implementation of the controversial rice-pledging scheme before the Supreme Court’s criminal division for holders of political office.

Kittiratt told the court the scheme was well-planned in terms of its economic worthiness and there was no fiscal mismanagement as alleged by the public |prosecutors.

Former PM Yingluck is facing charges of negligence of her official duty in overseeing the rice-pledging scheme, which cost taxpayers more than Bt500 billion.

Kittiratt, also a former deputy PM of the Yingluck government, said the project was necessary in terms of addressing the economic inequality faced by farmers and low-income people, while the target groups were 3.7 million farm households or a total of 15 million people.

On the Bt15,000-per-tonne rice-pledging price, Kittiratt said the price, which doubled the prevailing market price, was based on farmers’ production costs and a minimum wage of Bt300 per day, as the Yingluck government had also raised the starting salary for new graduates with a bachelor’s degree to Bt15,000 per month.

He said there were studies on the merits of rice-pledging schemes in comparison with other methods to help farmers such as farm price insurance schemes implemented by previous governments.

However, these studies found that farmers did not get the guaranteed price as stated and there were difficulties in verifying in the |registration of farmers qualified to join the insurance schemes since rice crops took only two to three months before they were ready for harvesting.

The former minister said funds used in the rice-pledging scheme came from the Bank for Agriculture and Agricultural Cooperatives, as with loans guaranteed by the Finance Ministry, while the government at the time ensured that working funds used in the scheme did not exceed Bt500 billion.

Asked why the Yingluck government did not suspend the scheme after receiving repeated warnings from anti-graft authorities, he said the arguments used in these official warnings were based on problems of previous rice-pledging schemes.

And he said, the government was told the scheme was economically worthwhile – the National Economic and Social Development Board at the time had insisted farmers would be better off as a result of the scheme.

Kittiratt told the court there were significant sales of rice bought from farmers under the scheme and he was confident the government would have been able to empty its inventory if there had been no coup in 2014.

Warum wohl?

FORMER PRIME minister Yingluck Shinawatra said Thursday that the government’s order for her to pay Bt35 billion in compensation would leave her destitute and cause her to suffer severely.

She has called on the Administrative Court to revoke the administrative order issued by the Finance Ministry seeking massive damages in connection with her government’s rice-pledging scheme.

The ministry’s civil damages fact-finding committee earlier concluded that the scheme incurred an estimated Bt178.5 billion in losses to the state, finding that Yingluck, as prime minister at the time, was responsible for 20 per cent of the damage, which amounted to Bt35.7 billion.

She is accused of negligence and for failing to stop damages incurred by the scheme.

“If my assets are seized, I will suffer severely. This will be a huge debt that I will not be able to pay during my lifetime. I will be left destitute. The suffering cannot be explained,” Yingluck said in a shaking voice.

The former prime minister added that the rest of her family would also suffer if her assets are seized.

555555555555!

The Central Administrative Court has accepted a lawsuit filed by former prime minister Yingluck Shinawatra to revoke the administrative order demanding that she pay 35.7 billion baht for damages incurred by the rice-pledging programme during her administration.

The lawsuit is the natural first step the former prime minister had to take to delay the execution of the military government’s order, which requires her to pay the amount within 30 days after receiving it or the Legal Execution Department will start liquidating her assets.

The court on Friday ordered a special panel set up to handle her case, led by its president. It has seven judges in total, compared with four in most cases.

Ms Yingluck filed the suit against Prime Minister Prayut Chan-o-cha and three other officials on Dec 26.

beteiligt waren.

Ms Yingluck was speaking to reporters on arrival at the Supreme Court’s Criminal Division for Holders of Political Positions for her trial in the rice-pledging case around 9am on Friday.

Meanwhile, ousted prime minister Yingluck Shinawatra insisted Tuesday she had never taken advantage of farmers by buying and re-selling their rice.

Writing on Facebook, Ms Yingluck said she bought the milled rice from farmers in northeastern provinces at a price of 20 baht/kg, a profitable price for farmers, and sold the rice at 20 baht/kg without taking a profit.

“If I wanted to make a profit or pass the burden to the end buyers, I would have had to sell the rice at 25 baht/kg,” she wrote.

Ms Yingluck said her move to buy rice from farmers was aimed at providing farmers with an alternative channel to sell rice without middlemen, which would help them save on costs. “Regrettably, my intention as a citizen to help farmers during this hard time was interpreted in other ways,” she said.

Ms Yingluck was responding Democrat Party member Warong Dejkitwikrom who said Ms Yingluck’s selling price at 20 baht/kg was designed to undercut and hurt farmers as she could buy the rice and sell it at higher prices but chose not to do so.

The justice minister has received a list of 6,000 state officials suspected of malfeasance leading to losses totalling 142 billion baht in the Yingluck Shinawatra government’s rice-pledging scheme.

Minister Paiboon Koomchaya said at Government House on Tuesday that the list came from the Prime Minister’s Office and the ministries of agriculture, commerce, finance and interior.

Of the 6,000 names, 2,000 were former ministers and members of sub-committees at executive levels, and the other 4,000 were officials at operational levels, the justice minister said.

That did not mean all of the listed people had already been found guilty, Gen Paiboon said. Authorities would examine the details to confirm those really responsible for the loss, and how much they should pay individually to compensate the state.

He also said the Interior Ministry had yet to list business operators also responsible for the 142 billion baht loss.

The government is demanding 178 billion baht in compensation for the losses accumulated by Ms Yingluck’s rice-pledging scheme for the 2012-2014 crops. The former prime minister has been ordered to pay 20% of the sum, or 35.7 billion baht. The military government blames her for not stopping the scheme once it was found plagued with losses and corruption, despite being advised repeatedly to do so.

The government has said it would order the other government officials involved, and business operators, to pay the remaining 80%, totalling 142 billion baht.

Former prime minister Yingluck Shinawatra admitted emotionally Thursday that she would be unable to pay the civil liabilities stemming from her government’s corruption-plagued rice pledging scheme.
I don’t know how to pay it up

Former prime Yingluck Shinawatra visited Ubon Ratchathani to bur rice directly from farmers for reselling in Bangkok.

Her aides said she planned to buy about two or three tonnes of rice directly from farmers in both milled and paddy rice.
For the paddy rice, she planned to have it milled for reselling in Bangkok.

Dann hätte man schon mal 2+ Mio to vom Markt

Prime Minister Prayut Chan-o-cha yesterday said he would not oppose politicians helping farmers by buying their rice.
“Certainly they can do so. But they should not just focus on trying to create a good image for themselves. They should sincerely buy rice from farmers,” Prayut said.
The PM said that at a recent scene, farmers who sold their rice to politicians immediately shut down their roadside booth after the politicians left, showing no interest in selling their rice to passers-by. He appeared to imply that the scene was set up.

THE INITIAL meeting of state agencies intended to expedite cases related to the previous government’s rice-pledging scheme failed to proceed yesterday after Finance Ministry staff did not show up.
Justice Minister Paiboon Koomchaya, who was to chair the meeting, said he did not know why Finance Ministry representatives failed to attend.

“I do not know why the ministry did not come. We could not carry on the meeting without a key agency such as the Finance Ministry,” Paiboon said after learning about the absence.

The meeting chairman and other participants waited for almost an hour in a meeting room at the Justice Ministry.

In his capacity as head of the Anti-Corruption Operation Centre (ACOC), Paiboon said yesterday that the next meeting had not yet been scheduled.

He added that the centre would ask the Finance Ministry permanent secretary in writing why his agency did not send representatives to attend yesterday’s meeting, which had been called at the instruction of the Cabinet.

He also said the ACOC was supposed to report to the prime minister at the weekly Cabinet meeting today about the results of the meeting.

“It had been widely known that there would be a meeting. The media also knew about this,” he said.

Paiboon’s attempt to convene the first meeting of relevant agencies was in response to a Cabinet resolution instructing the agencies under the ACOC to jointly investigate cases in connection with the corruption-plagued subsidy programme.

Wer herrscht nun in Thailand?
Immer noch Thaksin! Oder?

Prime Minister Prayut Chan-o-cha should forward a case seeking compensation from former premier Yingluck Shinawatra for damages caused by her government’s rice-pledging scheme to the Civil Court, says her lawyer.

Noppadon Laothong cited the case of former central bank governor Rerngchai Marakanond, who has been cleared by the Supreme Court in a decade-long battle involving the loss of 186 billion baht just before the 1997 economic crisis.

Mr Noppadon, who also represented Mr Rerngchai in his case, said the government at the time filed a civil suit against Mr Rerngchai.

He argued the current government failed to offer Ms Yingluck a chance to seek justice by issuing an administrative order seeking 35.7 billion baht in compensation from her instead of taking the case to the Civil Court as in Mr Rergnchai’s case.

Also keine eigenen kriminelle Handlung begangen haben.

Thailand’s first female prime minister on Sunday told the man who ousted her government two years ago to investigate his own brother over corruption allegations in an unusually strong broadside against the junta.
“The Prime Minister (Prayut) says that all the legal actions against me are based on the law and are not bullying,” Yingluck wrote on her Facebook account on Sunday.

“I would like the Prime Minister to apply the same logic and justice given to me like he gives justice and protection to his brother and other people who are on his side. Because the laws should be enforced for everyone, not just used only against my side.”

BP Kommentar in Yinglucks Haarwuchszentrum einzuträufeln,

FORMER PRIME minister Yingluck Shinawatra has requested the National Anti-Corruption Commission (NACC) to appoint a new chairperson to the subcommittees tasked with investigating her alleged wrongdoings in six criminal cases.
In a petition submitted to the anti-graft body on behalf of Yingluck, her lawyer Norawich La-laeng said that Supa Piyajitti, an NACC commissioner who heads six subcommittees, is not fit for the task due to her antagonistic views about the former prime minister.

Among the pending cases are those concerning alleged mismanagement during the massive 2011 floods and alleged wrongdoings in payment of compensation to those affected by political unrest.

Norawich said Supa was head of the subcommittee in charge of accounting for the previous government’s rice-pledging scheme and she had leaked confidential data to the opposition and later testified in the Supreme Court against Yingluck in the rice-pledging case.

As a result, she is an antagonist and biased against the defendant. So it is not fair for the anti-graft body to appoint such a person to take charge of investigation in other cases involving Yingluck, the petition said.

Former Prime Minister Yingluck Shinawatra has said she hopes she is the last leader ousted by a coup. The remark was made on the 10th anniversary of the 2006 coup yesterday.
“We lose the opportunity to stand gracefully among world communities every time we have a coup,” she said.

Yingluck’s elder brother, the fugitive ex-premier Thaksin, was toppled by a coup on September 19, 2006.

Yingluck said her Pheu Thai government was overthrown in the 2014.

Acting Pheu Thai secretary general Phumtham Wechayachai said throughout the past 10 years Thai society had been divided and the country’s principles distorted.

He said the coup was a victory over democracy and justice.

“I still have hope and wait for the day democracy, justice and better living return to the country,” he said.

Hat also Yingluck Räubertochterschwester Recht?

“I still have hope and wait for the day democracy, justice and better living return to the country,” he said.

PRIME MINISTER Prayut Chan-o-cha has invoked Article 44 of the interim charter to enable the seizure of assets of those responsible for the rice-pledging scheme.

Former prime minister Yingluck Shinawatra and her commerce minister Boonsong Teriyapirom, among others, could have their assets seized over the massive damages.

The Department of Legal Execution has been empowered to seize assets of state officials found guilty of breaking the civil-liability law.

A fact-finding committee appointed by the Prayut government concluded that the previous Yingluck government’s rice-pledging scheme had resulted in losses of more than Bt200 billion in taxpayers’ money.

According to Prayut, the Department of Legal Execution will help enforce the law to ensure that state officials face civil liability lawsuits since the Commerce Ministry has dragged its feet in pursuing the cases against Yingluck and Boonsong.

The deadline for filing the civil-liability lawsuits is February next year.

Deputy Prime Minister Wissanu Krea-ngam said other aspects of the justice process in this case remained unchanged.

However, the Commerce Ministry needs help because the estimated losses and value of assets in question are high.

The Commerce Ministry is waiting for an order from Prime Minister Prayut Chan-o-cha demanding that politicians connected with the previous administration’s government-to-government (G2G) rice sales provide compensation for financial losses connected to the allegedly fake deals.

The prime minister needs to take urgent action before the two-year statute of limitations for the case runs out next February, said Commerce Minister Apiradi Tantraporn.

She added her staff was waiting for a reply from the Prime Minister’s Secretariat. However, Ms Apiradi said she was confident the measure, recommended by the Council of State, could be carried out before the case expires.

Six former Commerce Ministry officials are believed to be linked to the allegedly fraudulent sales and will be asked to pay back to the state a total of 20 billion baht — an estimate calculated by the Finance Ministry — if the prime minister issues the order.

PHEU THAI PARTY yesterday petitioned Prime Minister Prayut Chan-o-cha over alleged discrimination and human rights violations committed by the Roi Et governor after he halted the distribution of calendars embossed with pictures of ex-prime ministers Thaksin and Yingluck Shinawatra.

Pheu Thai caretaker leader Pol Lt-General Viroj Pao-in signed the petition, which cited media reports that said Governor Anusorn Kaewkangwan instructed all district chiefs in the province to halt the distribution of the 2016 calendars.

Anusorn cited the need to foster peace and reconciliation for the move.

But Viroj said the action was a human rights violation.

He said many ordinary people and juristic bodies were entitled to produce calendars for the New Year and distribute them.

“To give out calendars is to send a message of love and connection between people so it should not disturb the peace or ruin reconciliation as alleged by the governor,” Viroj wrote.

He said only calendars with pornographic material should be banned. People had the right to reject the calendars, he noted.

“Restoring peace and reconciliation should be carried out with fairness and regards to human rights and should not be politicised.”

THE Supreme Court’s Criminal Division for Political Office Holders will hear the first witness testimony on January 15 next year and the last testimony on November 18, in the case against Yingluck Shinawatra, the court said yesterday.

Yingluck thanked the court for allowing testimony by witnesses, such as Chalerm Yoobamrung, who did not have a chance to give a statement to the National Anti-Corruption Commission.

Yingluck also thanked her supporters, who said they would wear red as a gesture of support for her on Sunday. She advised them to heed the government’s order, as she wanted peace and reconciliation in the country.

Norrawit Larlaeng, Yingluck’s lawyer, said the defence witnesses include Yingluck, former Finance Minister Kittiratt Na-Ranong, former deputy prime-minister Niwatthamrong Boonsongpaisan, former chief adviser to the PM Olarn Chaiprawat, former deputy commerce minister Yanyong Puangrat, veterinarian and academic Chai Watcharong and CP Intertrade chairman Sumet Laomoraporn.

Meanwhile, former prime minister Thaksin Shinawatra posted a message on Instagram, saying reconciliation must stem from “one who believes in justice”.

THE committee set up to probe ex-premier Yingluck Shinawatra over her government’s controversial rice-pledging scheme has given her an additional 30 days to explain her actions.
Deputy Prime Minister Wissanu Krea-ngam yesterday said there were some more questions the committee wanted to ask Yingluck despite the process’ original deadline passing last month. He did not elaborate.

Wissanu insisted that Yingluck was negligent in allowing the scheme to inflict huge losses on the country.

The government is expected to seek up to Bt500 billion in compensation from Yingluck due to the damage caused to the country by the scheme.

However, according to the law a defendant can negotiate to reduce the compensation figure, Wissanu said.

Government Spokesman Maj-General Sansern Kaewkamnerd expressed displeasure over Yingluck and her lawyer Norrawit Larlaeng’s decision to write an open letter to Prime Minister General Prayut Chan-o-cha in which Yingluck appealed to him.

“Why do they give hints to the plaintiff [the government]?” he said. “They could just let us blunder on so they are at an advantage if the court sees their point of view.”

Norrawit said Yingluck had appealed to Prayut in several letters but was yet to receive replies and that was why she had written an open letter to him.

He added that the working procedure of the investigation committee was not fair to Yingluck.
